Moderatpers.com – (24/9/2020) dua bulan lalu, kita mengenang tragedi Semanggi II yang tak terasa sudah 21 tahun silam. Hari ini, (13/11/2020) kronologi sejarah mencatat sebelum 24 September 1999, tragedi Semanggi telah terjadi tidak hanya sehari, namun tiga hari berturut – turut, yaitu 11 – 13 November 1998. Melawan lupa tragedi pertumpahan darah 22 tahun silam. Mengapa kita perlu mengenang sejarah yang sudah terlampau lebih dari dua dekade ini?
Seperti yang kita ketahui, 1998 adalah tahun dimana masa transisi dari pemerintahan orde baru menuju reformasi. Masa – masa awal dimana Indonesia bangkit dari kekuasaan otoriter orde baru kepemimpinan Soeharto yang digantikan oleh B.J. Habibie. Salah satu kejadian luar biasa bentrok antara aparat dan masyarakat adalah tragedi Semanggi I ini, yang juga menyebabkan tewasnya warga sipil. Lantas apa latar belakang terjadinya tragedi itu?
Tragedi Semanggi I terjadi karena aksi protes mahasiswa dan masyarakat dari berbagai elemen yang melancarkan protes atas pelaksanaan Sidang Istimewa (SI) MPR/DPR yang menunjuk B.J. Habibie sebagai pengganti Soeharto di kursi presiden. Mahasiswa tidak terima dengan keputusan tersebut, karena B.J. Habibie dinilai sama saja atau kepanjangan tangan dari kepemimpinan Soeharto selama 32 tahun. Hal itu dianggap sebagai mempertahankan status quo. Selain itu, dwifungsi ABRI yang telah tertanam kuat juga tidak mungkin dihapuskan. Dwifungsi ABRI/TNI dianggap sebagai penyebab bangsa ini tidak pernah maju. Karena kekuasaan terpusat hanya dikalangan tentara saja. Masyarakat mendesak agar menyingkirkan militer dari politik serta pembersihan pemerintah dari orang – orang Orde Baru. Aksi yang dimulai sejak 11 September 1998 ini dimulai dengan berkumpulnya mahasiswa dan elemen masyarakat yang bergerak dari Jalan Salemba, bentrok dengan Pam Swakarsa, kelompok sipil bersenjata yang dibentuk TNI, di sekitar kompleks Tugu Proklamasi.
Kemudian pada tanggal (12/11/1998), ratusan ribu mahasiswa dan masyarakat bergerak menuju ke Gedung MPR/DPR dari segala arah, Semanggi – Slipi – Kuningan. Namun, hari itu tidak ada satupun yang berhasil sampai ke Gedung MPR/DPR karena dikawal sangat ketat oleh para aparat. Aksi berlangsung tanpa kenal waktu, hingga pada malam harinya, terjadi bentrok di daerah Slipi dan Jl. Sudirman. Puluhan mahasiswa dilarikan ke rumah sakit dan ribuan mahasiswa juga dievakuasi ke Universitas Atma Jaya. Pada hari itu, satu orang pelajar bernama Lukman Firdaus tewas akibat luka yang cukup parah.
Esok harinya, (13/11/1998), mahasiswa dan elemen masyarakat yang berada di Universitas Atma Jaya Jakarta bergerak ke Semanggi dan sekitarnya. Mereka dikepung di Jl. Jenderal Sudirman oleh aparat. Mereka dikepung dengan kendaraan lapis baja aparat, gas air mata dan peluru tajam pun juga berdesingan. Aksi pada hari ketiga ini adalah puncak dari bentrokan masyarakat dengan aparat untuk menyerukan keadilan. Selama aksi ini berlangsung, tim relawan untuk kemanusiaan melaporkan ada 17 orang tewas. Diantaranya adalah Sigit Prasetyo (YAI), Heru Sudibyo (UT), Engkus Kusnadi (Universtas Jakarta), Muzammil Joko (UI), Uga Usmana , Abdullah/Donit, Agus Setiana, Budiono, Doni Effendi, Rinanto, Sidik, Kristan Nikijulong, Hadi, dll. Dari 17 orang tersebut, terdiri dari 6 orang mahasiswa, 2 orang pelajar SMA, 2 orang anggota aparat keamanan POLRI, seorang anggota Satpam Hero Swalayan, 4 orang anggota Pam Swakarsa dan 3 orang warga masyarakat. Sementara sekitar 456 korban mengalami luka – luka akibat tembakan senjata api dan pukulan benda keras, tajam / tumpul.
Meskipun sudah lebih dari dua dekade, tragedi Semanggi ini belum menemukan titik pasti. Dimana kasus HAM nya belum terselesaikan hingga kini. Dikutip dari Kompas.com, publik sempat di gegerkan dengan pernyataan Jaksa Agung ST Burhanuddin yang mengatakan bahwa Tragedi Semanggi I dan II bukan merupakan pelanggaran Hak Asasi Manusia (HAM) berat. “Peristiwa Semanggi I dan II, telah ada hasil rapat paripurna DPR RI yang menyatakan bahwa peristiwa tersebut bukan merupakan pelanggaran HAM berat,” kata Burhanuddin di Kompleks Parlemen, Senayan, Jakarta, Kamis (16/1/2020). Kendati demikian, Burhanuddin tak menyebutkan kapan rapat paripurna DPR yang secara resmi menyatakan peristiwa Semanggi I dan II tidak termasuk dalam kategori pelanggaran HAM berat. Namun, berdasarkan penelusuran berbagai media termasuk Kompas.com, DPR periode 1999-2004 pernah merekomendasikan bahwa Peristiwa Semanggi I dan II tidak termasuk dalam pelangggaran HAM berat.
Menindaklanjuti pernyataan tersebut, keluarga korban tidak diam dan membungkam. Pada tanggal (12/5/2020), keluarga korban Tragedi Semanggi I dan II menggugat Jaksa Agung ST Burhanuddin ke Pengadilan Tata Usaha Negara (PTUN). Menurut keluarga korban, dan para aktivis HAM, pernyataan seorang Jaksa Agung ini dianggap sebagai perbuatan melanggar hukum oleh badan dan/atau pejabat pemerintah. Jaksa Agung telah merugikan keluarga korban yang telah kehilangan anggota keluarga dalam tragedi tersebut.
Menaggapi hal tersebut, pihak Kejagung resmi melayangkan banding atas putusan PTUN Jakarta pada tanggal (9/11/2020). Sebelumnya, putusan majelis hakim PTUN menyatakan jaksa agung ST Burhanuddin melakukan perbuatan melawan hukum melalui pernyataannya dalam forum Rapat Kerja DPR RI pada (16/1/2020) tentang Tragedi Semanggi I dan II. Hakim PTUN juga mewajibkan tergugat untuk membuat pernyataan terkait penanganan dugaan pelanggaran HAM berat Semanggi I dan II sesuai keadaan yang sebenarnya dalam rapat kerja dengan Komisi III DPR RI berikutnya, sepanjang belum ada putusan yang menyatakan sebaliknya.
Kendati demikian, pihak Kejagung justru menyebut putusan hakim PTUN itu melanggar UU Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan. Salah satunya menurut Jaksa Agung Muda Perdata dan Tata Usaha Negara Kejagung, Feri Wibisono. lantaran mengkualifikasikan surat terbuka yang dibuat penggugat ke presiden sebagai banding administrasi sebagaiamana diatur di dalam Pasal 78 ayat 2 UU Administrasi Pemerintahan. Dikutip dari CNN Indonesia, “Kami lihat hakim telah mencampuradukkan dan melanggar ketentuan yang berlaku dalam pasal 78 ayat 2 UU 30 Tahun 2014,” kata Feri dalam konferensi pers di Kejagung, Jakarta Selatan pada Kamis (5/11/2020). PTUN Jakarta dituding mengabaikan alat bukti dari seorang ahli yang mengatakan bahwa surat terbuka penggugat ke presiden tidak dapat dikategorikan banding administrasi. Itu sebab Kejagung memilih jalan banding.
Jauh sebelum kejadian 2020 ini terjadi, jika melihat tahun kejadian yaitu 1998-1999, Tragedi Semanggi I dan II ini menurut ketantuan UU No. 26 Tahun 2000, pelanggaran HAM berat yang terjadi sebelum berlakunya UU tersebut dapat diselesaikan melalui Pengadilan HAM Ad hoc yang dibentuk dengan Keputusan Presiden atas usul DPR (Pasal 43) atau melalui Komisi Kebenaran dan Rekonsiliasi (Pasal 47). Keluarga korban dan pegiat aktivis HAM beharap, dari peristiwa ini pemerintah segera menuntaskan penyelidikan dan membawa kasus – kasus pelanggaran HAM berat belasan bahkan puluhan tahun “terbengkalai” ke pengadilan HAM ad hoc sehingga tercipta kepastian hukum. Kasus Semanggi I dan II hanyalah Sebagian dari banyaknya kasus pelanggaran HAM di Indonesia. Dari putusan PTUN tersebut, agaknya masyarakat bisa menilai bahwa aparat penegak hukum kita semakin melemah. Kuasa hukum dari pihak keluarga korban dan koalisi pun menyebutkan bahwa Burhanuddin sudah tidak layak menjabat sebagai Jaksa Agung.
Lebih lanjut, ketua bidang Advokasi YLBHI, Isnur menyatakan bahwa Jaksa Agung adalah representasi dari ketidakmampuan negara dalam menyelesaikan pelanggaran HAM berat. “Ini bukan soal kemampuan, kapasitas dan kapabilitas, karena bisa dilakukan dengan mudah dan cepat, tapi problemnya adalah ketidakmauan. Tidak mau menuntaskan kasus – kasus HAM berat sampai sekarang, bertahun – tahun, tidak serius,” kata Isnur.
